Mobile Messaging Service Terms and Conditions

Omy Laboratories (hereinafter "We", "Us", "Our") offers a mobile messaging service (the "Service") operated by Psycos dermocosmétiques inc. Your use of the Service constitutes your acceptance of these terms and conditions ("Mobile Terms"). To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service after the effective date of such modifications shall constitute your acceptance of such modifications.

User registration

By registering with Omy Laboratories SMS/Text Messaging Service in an affirmative manner, such as via online or application-based registration forms, you agree to receive recurring SMS/Text marketing messages on behalf of Psycos dermocosmetics inc. operating as Omy Laboratories. Messages will be sent via your wireless carrier to the cell phone number you have provided, even if your cell phone number is registered on a national or federal Do Not Call list. Text messages can be sent using an automatic telephone dialing system or other technology. You understand that you are not required to register for this program in order to make purchases, and your consent is not a condition of any purchase from Psycos dermocosmétiques inc. Your participation in this program is entirely voluntary.

Cost and frequency

We do not charge for the Service, but you are responsible for all fees and charges associated with text messaging imposed by your wireless service provider. Message frequency varies. Standard message and data rates may apply with your wireless carrier. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including your wireless carrier's charges.

Program description

Without limiting the scope of the program, users who opt-in to the program can expect to receive messages regarding the marketing, promotion, payment, delivery and sale of digital and physical products, services and events. Messages may include payment reminders.

User unsubscription

Omy Laboratoires mobile messaging service (the “Service”) is operated by Psycos dermocosmétiques inc. ("Us”, “We”, “Our”). Your use of the Service constitutes your acceptance of these terms and conditions (“Mobile Terms”). We may change or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also amend these Mobile Terms at any time and your continued use of the Service after the effective date of such changes will constitute your acceptance of such changes. By consenting to Psycos dermocosmetic inc. SMS/text messaging service, you agree to receive recurring SMS/text messages with messages, including and on behalf of via Psycos dermocosmetic inc. text messages via your wireless service provider to the mobile phone number you provided, even if your mobile number is registered on a national or federal do not call list. Text messages can be sent using an automatic telephone numbering system or other technology. You understand that you do not have to sign up for this program to make purchases, and your consent is not a condition of any purchase with Psycos dermocosmetic inc.. Your participation in this program is entirely voluntary. We do not charge the Service, but you are responsible for all text messaging fees and charges imposed by your wireless service provider. The frequency of messages varies. Standard rates for messages and data may apply to your wireless service provider. Check your mobile plan and contact your wireless service provider for details. You are solely responsible for all charges related to SMS/text messages, including your wireless service provider’s charges. You may unsubscribe from the Service at any time. Send the STOP single keyword order to +1 (844) 916-2068. Click the unsubscribe link in any text message to cancel. You will receive a unique unsubscribe confirmation SMS. No other message will be sent to your mobile device unless you have initiated it. If you are a subscriber to other mobile messaging programs and wish to cancel, unless otherwise required by applicable law, you will need to unsubscribe separately from such programs by following the instructions provided in their respective mobile terms. Limitation of certain damages

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, PUNITIVE, SPECIAL, EXEMPLARY, INCIDENTAL, CONSEQUENTIAL OR OTHER DAMAGES OF ANY KIND (INCLUDING FOR PERSONAL INJURY, LOST PROFITS, PAIN, SUFFERING AND EMOTIONAL DISTRESS, AND LOSS OF DATA, INCOME, ENJOYMENT AND ECONOMIC BENEFIT). THE FOREGOING LIMITATION OF PUNITIVE AND EXEMPLARY DAMAGES AND ALL DISCLAIMERS OF LIABILITY FOR PERSONAL INJURY OR PROPERTY DAMAGE OR FOR ANY INJURY CAUSED BY FRAUD OR INTENTIONAL MISREPRESENTATION ON THE PART OF OMY LABORATORIES.

Disclaimer of warranties

YOU EXPRESSLY UNDERSTAND AND AGREE THAT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOUR USE OF THE SOFTWARE AND VIA THE SERVICE IS ENTIRELY AT YOUR OWN RISK.

Cancellation and/or refund policy

No requests for refunds or order cancellations can be made via the messaging system (the "Service"). For all requests or questions, please contact customer service by email at info@omycosmetics.com.

 What should I do if I have received a defective product ?

If you have received a product and it is defective, we invite you to contact customer service by e-mail at info@omycosmetics.com within 5 days of receiving your package.

In your e-mail, please include the following information:

  • Subject: Defective product
  • Order number and full name on file
  • Attach a photo of the damaged product(s)

A customer service representative will contact you shortly.

How does your satisfaction-guaranteed policy work ?

Omy is committed to providing you with an effective product that will suit your needs, or we will replace it. If you are not satisfied with your product after 28 days of use, please contact customer service at info@omycosmetics.com within 40 days of purchase*.

If you purchased from one of our official retailers, please contact them directly.

In order to be able to reformulate your product in a timely manner, please include:

  • As many details as possible about your skin;
  • Your experience with the current product;
  • If possible, include the order number or name on file.

This will enable us to analyze the situation and suggest the right product for you.

No refunds unless instructed otherwise by our Pharmacy Doctor.

* As the skin regenerates approximately every 28 days, a product must be used for a minimum of 28 days before its effectiveness can be judged.

**Requests for reformulation (personalized care)/exchange must be made within 40 days of purchase. Not applicable to gift cards, gifts with purchases, accessories, forgotten subscriptions and/or duplicate products.

****When a product is reformulated, the original product must be returned to us. Reformulation is an exchange for a new product. Therefore, no empty containers will be reformulated.

Terms and Conditions of the “Le Lab” Loyalty Program

"Le Lab" Loyalty Program Terms and Conditions

Please read these terms and conditions carefully before participating in the “Le Lab” loyalty program. By registering, you agree to comply with the terms outlined below, including all terms incorporated by reference. If you do not accept these terms, please do not participate.

1. Eligibility and Program Overview

1.1 Eligibility and Participation Conditions

The Le Lab loyalty program (“Program”) is operated by Omy Laboratoires (“we,” “our,” or “us”) and is intended for personal use only. Membership is limited to one account per person; organizations, companies, or groups are not eligible. Participants must be legal residents of Canada or the United States, have reached the age of majority in their jurisdiction, and possess a valid email address. No purchase is required to join. Omy Laboratoires reserves the right to refuse account creation or to terminate accounts at its discretion. Employees and business partners of Omy Laboratoires may participate in a personal capacity only, and certain exclusions from Program benefits may apply.

1.2 Acceptance of Terms and Consent

By joining the Program, members (“you,” “your,” or “Member”) confirm that they have read, understood, and accepted these terms, as well as all related policies, including our Privacy Policy. These terms may be modified, and members are encouraged to review them regularly. Participation in the Program also constitutes consent to receive marketing communications from Omy Laboratoires in accordance with applicable law. If you do not accept these terms, you may not participate. The Program is void where prohibited by law.

2. Enrollment in the “Le Lab” Program

2.1 How to Enroll

Eligible individuals can enroll by visiting https://omycosmetics.com/en/account/register and completing the registration process.

2.2 Required Information

Enrollment requires a valid email address. Members must create an account with their name and password in order to access benefits and rewards. Members are responsible for updating and ensuring the accuracy of their account information.

2.3 Single Account per Person

Only one Program account is allowed per email address. In the event of a dispute regarding account ownership, the “authorized account holder” of the email address used during registration will be considered the account owner.

2.4 Accounts and Attribution of Benefits

Purchases are permanently linked to the email address used at the time of purchase and cannot be transferred or credited to another account, even if you no longer have access to your previous email. This rule ensures the integrity of the Program and the protection of customer data.

It is not possible to change the primary email address of an account once it has been created. The email address acts as a unique identifier for loyalty tracking. If a customer wishes to use a new email address, they must create a new account and start a new Program journey.

2.5 Consent to Marketing Communications

To receive early access to sales and product launches, as well as updates on rewards, challenges, and exclusive offers, members must consent to receive marketing communications via email or SMS. This consent may be given or withdrawn at any time, either via the preference center available at the bottom of emails sent by Omy Laboratoires, or by contacting our customer service by phone at 1‑877‑669‑7345, by email at info@omycosmetics.com, or via chat by clicking the icon at the bottom of the screen.

3. Program Operation

3.1 Program Rewards

The Program rewards members for purchasing products and participating in specific activities on our website. Members can accumulate rewards, reach different loyalty levels, and access benefits associated with each level. Opportunities to earn rewards are detailed on the Program page or communicated through other channels (e.g., social media, emails, etc.). Additional information is available in our FAQ.

3.2 Tier Structure

The Program is based on tiers determined by the amount spent on omycosmetics.com or any other channel determined at Omy Laboratoires’ sole discretion (“Eligible Purchases”) on a cumulative basis, as long as the Program is in effect. In addition, to ensure all eligible purchases are counted, you must be logged into your Program account before completing the actions listed on the Program page.

3.3 Attribution of Rewards

The reward, if any, granted for each action is determined by Omy Laboratoires at its sole but reasonable discretion.

3.4 Levels and Reassessment of Benefits

The Program includes four levels with associated benefits:

  • Level 1 – Discovery: $0 – $299 cumulative spending

  • Level 2 – Exploration: $300 – $599 cumulative spending

  • Level 3 – Expertise: $600 or more cumulative spending

  • Level 4 – Elite: Active subscription to one or more personalized products*

*Eligible products: Personalized Day Cream (Eligible formats: Regular and Refill), Personalized Night Cream (Eligible formats: Regular and Refill), Personalized 5% Niacinamide Serum (Eligible formats: Regular and Refill), Personalized Skincare Set (Eligible formats: Regular and Refill)

Starting September 29, 2025, all existing customer accounts, as well as new accounts, will be automatically placed at the Discovery level upon accepting the Program’s terms and conditions, marking the starting point for all journeys in Le Lab. Advancement to higher levels is automatic: as soon as a customer reaches the spending threshold for the next level, they are immediately promoted, with no manual action or delay required.

Each year, on the Program’s anniversary date (September 29), all loyalty levels are automatically reassessed based on cumulative spending between September 29 of the previous year and September 29 of the current year. Existing members retain their level for a full year and must then meet the required spending for their level to maintain it for the following year.

Purchases considered to determine the current level correspond to the last 12 months. Each year, on the Program anniversary date (September 25), all loyalty levels are automatically reassessed based on cumulative spending between September 24 of the previous year and September 25 of the current year. Historical members retain their level for a full year and must then meet the required amount for their level to maintain it for the following year.

To maintain Elite level, members must keep an active subscription to at least one personalized product at all times*. Without an active subscription, they will be placed at the level corresponding to their cumulative spending and will automatically lose the benefits associated with the Elite level. Members can check their progress and the actions needed to reach the next level directly in their Le Lab customer account.

4. Program Benefits and Rewards

4.1 Rewards and Usage

As a member, your interactions with the Program (completing challenges, reaching a new level) allow you to earn rewards. To use your rewards, you must apply them – in the form of a promo code – to a subsequent purchase, in accordance with the conditions specified for each reward. Rewards cannot be applied to a purchase that has already been made. They can never be exchanged for cash and apply only to Omy Laboratoires orders.

You must be logged into your Le Lab account to use your benefits. Your eligible challenges and available rewards are listed in your personal account. Eligible members will receive an email notification when new rewards are available, unless they have opted out of Program communications.

4.2 Use of Rewards

Rewards can be used once they have been unlocked (visible when logging into your account) and are available for 6 months from the unlock date before expiration. Omy Laboratoires reserves the right, at any time and at its sole discretion, to cancel, modify, replace a reward, or change its expiration date, including in the event of a stock shortage or for any other reason deemed necessary. Rewards may be modified occasionally at the sole discretion of Omy Laboratoires.

You can select the reward you wish to apply to a subsequent order by entering the corresponding promo code in the cart section or during checkout. Certain restrictions and conditions may apply. Rewards cannot be combined in the same transaction.

Birthday Gift

The birthday gift is awarded only to members who have entered their date of birth in their Le Lab account before the start of their birth month. The first month in which the gift will be awarded is October 2025. The gift is automatically applied to the member’s account on the first day of their birth month and expires on the last day of the same month (29th, 30th, or 31st, depending on the month). The gift cannot under any circumstances be claimed retroactively for a month prior to adding the date of birth. The gift can be used without a minimum purchase, but if the order amount is below the free shipping threshold, shipping fees will apply. Omy Laboratoires reserves the right, at any time and at its sole discretion, to modify, replace, or remove the birthday gift, or to change the conditions of its award, without notice, in order to ensure the proper functioning of the Program and comply with legal requirements.


Free Consultations with a Skin Expert 

Consultations are offered free of charge and can only be booked via https://omycosmetics.com/en/pages/consultation, according to available time slots. Participation in this service is entirely dependent on slot availability. Omy reserves the right, at its sole discretion and without notice, to suspend, modify, or close all or part of the time slots, which may limit or make this benefit unavailable. No guarantee of booking or availability is provided.


Priority SMS Service

This service is offered only to members who have reached the Expertise and Elite levels. Coming soon.


Participation in Product Testing

At certain times, members may be invited to participate in product testing. Participation requires the ability to travel to Quebec at the following address: Omy Laboratoires
9100 John-Simons Street, Suite 200, Quebec, QC G2B 0S9, Canada. Emails will be sent to members at the Expertise and Elite levels when tests are required for Omy’s research and development team. Participation in these tests is entirely voluntary and depends on space availability. Omy reserves the right to modify, suspend, or cancel these tests at its sole discretion and without notice.

4.3. Non-Transferable Accounts and Rewards

Accounts, Program rewards, product rewards, benefits, and credits cannot be transferred, shared, or combined. Only the member who purchased the products can accumulate rewards, product rewards, benefits, and credits. Members will not receive product rewards, benefits, or points for purchases refunded by companies or other organizations not eligible for the Program. We reserve the right to control the number of accounts per household and to refuse, merge, or close additional or duplicate accounts at any time. Your account information (including security data) is confidential and must not be shared with others.

4.4. Value and Rights of Rewards

Rewards, product rewards, benefits, and credits earned through the Program have no monetary value, are non-transferable, and you hold no ownership rights over them or any other Program benefits. Credits assigned to your Program account will be reduced or canceled, as applicable, if all or part of a purchase is returned or canceled, or if the credit was obtained through fraudulent activity or any other activity violating these Program Terms. The sale, barter, transfer, or assignment of any reward, benefit, or credit offered through the Program, outside of us, is expressly prohibited.

4.5. Non-Exchange of Rewards

Rewards cannot be exchanged or returned for credits, another product, or a cash refund.

4.6. Personal Use of Products and Services

Products and services available through the Program, including rewards and any samples provided, are strictly for personal use. You may not sell or resell the products, services, or samples you purchase or receive. We reserve the right, without notice, to cancel or reduce any order or product/service provided if, at our sole discretion, we determine it could violate the Program’s terms. You may not share or publish promotional or referral codes obtained through the Program. Any shared code will be revoked and considered invalid.

4.7. Liability in Case of Fraud

We are not responsible for rewards or credits lost or used due to fraudulent activity by you or a third party.

4.8. Program Modifications

We reserve the right to modify Program benefits, the way each level is achieved, how credits are earned, and how your eligible purchases and activities are evaluated and rewarded at any time, without notice, at the sole discretion of Omy Laboratoires. We also reserve the right to limit the number of eligible purchases or activities for the Program and/or for a specific level or point, as well as the number or type of rewards or benefits you may receive or earn at a given level or point, during a given period or for the duration of the Program, and/or any combination of these conditions.

Omy Laboratoires reserves the right to modify these Terms at any time, without notice, at its sole discretion. Any modification takes effect upon publication and supersedes any prior version of these Terms. These modifications apply to any future disputes, regardless of when the contested interaction occurred.

4.9. Claims Regarding Program Purchases or Activities

If you believe that a purchase or other activity has not been correctly credited to your account, you must contact our Customer Experience team at info@omycosmetics.com. Your email must include: your name and the email address associated with the Program, the date of the purchase or Program activity, and a description of the issue(s) encountered. This email must be sent within forty-five (45) days following the date of the purchase or activity in question. Omy Laboratoires will determine, in light of the information submitted and at its sole discretion, whether the purchase or activity can be added to the account. We are not responsible for notifications sent late regarding purchases or activities that were not correctly credited.

4.10. Referral-Related Credits

Credits can be obtained and accumulated via the referral bonus corresponding to the level assigned to you. These credits are awarded when the referred customer makes their first purchase at Omy Laboratoires. No credit is awarded if the referred customer has previously made a purchase.

Once the referred customer completes their purchase, the credits will be assigned to the referrer’s account, provided all Program conditions are met.

Credits can be used for future purchases and can accumulate. When using credits, the member must choose the number of credits to use in increments of $5. If the credit balance is less than $5, they cannot be used, and the member must wait until the balance reaches the $5 minimum.

Credits can be combined with other rewards during purchases.

5. Marketing Communications

5.1. Program Registration and Related Communications

By registering for the Program, you will automatically receive communications related to the Program, including marketing emails regarding the Program as well as information about your Omy Le Lab account, your Rewards, and your benefits. Upon registration, you may also be asked to consent to receive other marketing communications from Omy Laboratoires.

5.2. Unsubscribing from Marketing Communications

You may unsubscribe at any time from receiving marketing emails or SMS messages from Omy Laboratoires by following the instructions provided in the message or as indicated in Omy Laboratoires’ Privacy Policy.

5.3. Transactional Communications

Certain transactional communications will continue to be sent to you even if you unsubscribe from marketing communications, as they are necessary for your participation in the Program. These include, without limitation, exchange confirmations, notifications of new rewards, profile updates, or any other communication directly related to your account.

5.4. Termination and Impact on Communications

If you terminate your membership in the Program, you will no longer receive communications related to the Program. If you unsubscribe from Program-related marketing communications, you will no longer receive information regarding Rewards or benefits to which you may be entitled.

5.5. Compliance with Applicable Laws

All communications related to the Program, including marketing emails and SMS messages, will be sent in compliance with applicable laws, including Canada’s Anti-Spam Legislation (CASL). Your consent will be required where the law mandates, and you may withdraw your consent at any time without affecting your participation in the Program (except for necessary transactional communications).

6. Termination and Modification

6.1. Program Modifications

The Program and its benefits are offered at the sole discretion of Omy Laboratoires. Except where prohibited by law, we reserve the right to modify, limit, cancel, or terminate these Terms, our FAQs, and/or any aspect or feature of the Program at any time and without notice. These changes may affect the value of Rewards or benefits already accumulated, as well as the ability to redeem them.

6.2. Suspension or Termination by Omy Laboratoires

We reserve the right to suspend or terminate your participation in the Program and to review your member account at any time, at our sole discretion. Any abusive use of the Program, violation of these Terms, illegal activity, fraudulent behavior, misrepresentation, or any act contrary to these Terms or harmful to our interests — including unauthorized use of Rewards, points, credits, vouchers, or certificates — may result in immediate termination of your membership. Upon termination, all accumulated benefits and Rewards will expire immediately, and you will lose access to the Program. In cases of suspected illegal activity, fraud, or abuse, we also reserve the right to pursue any appropriate legal action.

6.3. Voluntary Termination by the Member

If you decide to no longer participate in the Program, you may cancel your membership by writing to info@omycosmetics.com. In this case, you will immediately lose all accumulated benefits, credits, and tier statuses.

6.4. Severability

If any provision of these Terms, or any part thereof, is deemed invalid, illegal, or unenforceable, that provision or part will be severed only to the extent necessary. The remainder of the Agreement will remain fully valid and enforceable. If a provision can reasonably be modified to make it valid and enforceable while respecting the original intent of the parties, it will be modified accordingly.

7. Disclaimer of Warranties; Limitation of Liability

7.1. Legal Limits

Certain laws may not allow the exclusion or limitation of certain legal warranties, liabilities, or damages. If these laws apply to you, some or all of the exclusions or limitations below may not apply.

7.2. No Warranties

To the fullest extent permitted by applicable law, Omy Laboratoires, its affiliates, and its partners make no representations, warranties, or conditions of any kind, express or implied, regarding these Program Terms, the Program itself, or any of the benefits, rewards, credits, or points associated with the Program. This includes, without limitation, implied warranties or conditions of merchantability, non-infringement, ownership, or fitness for a particular purpose, except to the extent that such warranties or conditions cannot be legally excluded.

7.3. Limitation of Liability

To the fullest extent permitted by applicable law, you agree that Omy Laboratoires, its affiliates, and its partners will in no event be liable or responsible (whether under contract, tort — including negligence — or otherwise) for:

 (a) any business interruption;
(b) any delay or interruption in access to the Program;
(c) any loss, theft, corruption, destruction, non-delivery, misdelivery, or other alteration of data;
(d) any loss or damage of any kind arising from relationships with third-party sites, their presence on the Site, or the use of any Program reward, benefit, or credit;
(e) any virus, system failure, or malfunction that may occur in connection with your use of the Site, including when linking to or from third-party sites;
(f) any inaccuracies or omissions in the Program content; or
(g) any event beyond our reasonable control.

Omy Laboratoires does not guarantee or represent that the Program or its benefits will be uninterrupted, error-free, or that defects will be corrected.

7.4. Exclusive Remedy

If you are dissatisfied with the Program or have a dispute with us, your sole and exclusive remedy is to terminate your membership in the Program. To the fullest extent permitted by law, Omy Laboratoires will have no other obligation, liability, or commitment to you.

8. Governing Law and Dispute Resolution

Except as otherwise required by applicable law in your jurisdiction, this Program and these Program Terms are governed by and construed in accordance with the substantive law of the Province of Quebec and the laws of Canada applicable in that province.

9. Waiver of Class Actions and Jury Trial

If you are a resident of the United States, you also agree to the following provisions: Please read this section carefully — it may significantly affect your legal rights, including your right to participate in a class action or have a jury trial.

9.1. Waiver of Class Actions

Each party voluntarily, knowingly, and intentionally waives its right to participate in a class or group action against the other party in any dispute or proceeding (whether based on contract, law, tort, or any other legal theory). All claims must be brought individually only, and not as a plaintiff or member of any purported class, consolidated, representative, or similar action or proceeding.

9.2. Waiver of Jury Trial
